Terms of Service
By working with Plastiek or using our website, you agree to the terms below.
1. Scope of Work
Before a project begins, we’ll agree on a written scope. including deliverables, timelines, pricing, and review rounds. This is outlined in a proposal, contract, or written confirmation.
Any work added after the original scope that is outside of what was agreed will be re‑quoted and must be approved in writing before we proceed. You won’t receive unexpected costs.
2. Payment Terms
Standard terms are 50% upfront and 50% on delivery of the final approved work, unless otherwise agreed in writing.
Final assets (completed animation, final app build, video files, or other deliverables) are delivered only after the final payment is received. Work on the project may pause if payments are late by more than 7 days.
3. Revisions
Each project includes a defined number of revision rounds, depending on the scope. Revisions are intended to refine the agreed work, not completely restart the creative direction.
If changes amount to a new direction rather than refinement, we’ll quote that separately before proceeding. We’ll always keep you informed before anything is billed.
4. Timelines & Deadlines
We commit to a schedule based on the project’s agreed timeline and your timely feedback.
Delays in feedback or approvals can extend delivery. If there’s no response for 14 days, the project may be paused. Rescheduling your slot may incur a rebooking fee depending on our calendar.
5. Deliverables & Usage Rights
Once final payment is received:
You receive the final deliverables, such as completed animations, rendered videos, or app builds.
You have the right to use these deliverables for your intended purposes (publication, distribution, broadcast, etc.).
Source/project files are not included unless we’ve agreed to them separately.
Plastiek retains ownership of all underlying intellectual property and production assets.
6. Portfolio & Promotional Use
Unless you request otherwise in writing before we start, we may feature work we’ve completed for you in our portfolio, case studies, showreels, website, and social channels.
If your project involves sensitive or unreleased content, notify us upfront, and we’ll treat it confidentially.
7. Communication
We work primarily asynchronously using Slack, email. We aim to respond to project messages within 24–48 hours on weekdays.
If scheduled calls are required, we’ll arrange them mutually.
8. Cancellations
You may cancel a project at any time. If you do, you will be invoiced for:
All work completed up to the date of cancellation;
Any work in progress;
Any non-refundable expenses or third-party costs incurred for the project;
Any crew, contractor, or production costs reasonably committed or incurred by Plastiek in preparation for the project.
For larger productions involving multiple crew members or booked production resources, Plastiek may invoice for reasonable holding fees to cover commitments already made.
Projects paused for more than 21 days without written notice may be rescheduled at our discretion, and restart fees may apply.
9. Liability
We deliver work in good faith and with professional care. We are not liable for:
Indirect or consequential damages
Delays or technical issues arising from third‑party platforms or services
The performance of delivered animation or apps on external platforms
10. Confidentiality
Information you share with us, including creative briefs, materials, and internal documentation, remains confidential and will not be disclosed without your written permission.
We can sign a mutual NDA if required before we start.
11. Updates to Terms
We may update these Terms periodically. Continued engagement with our services constitutes acceptance of updated Terms.
